2. Order at City BBQ: As long as you're logged in when ordering online at citybbq.com or in the City BBQ app, or checking in when ordering in-person, every order you place January 1–February 29 is an entry. It doesn't matter you're a regular or a first-timer, either—we'll only count visits starting January 1, 2024, and every visit you make is another shot at winning! So dine in, pick up, or order for delivery as often as you like before February 29 for a shot at walking away with free BBQ for a year!

We'll randomly select one lucky winner from each location (as indicated by your favorite location in your City Rewards account). Winners will be announced March 4, 2024. Best of luck from all of us at City Barbeque!

Eligibility: The City Rewards “BBQ For a Year” Promotion (“Promotion”) is open to members of the City Rewards program who are 18 years of age or older during the Promotion Period and who are citizens or legal permanent residents of the United States and DC, excluding those who reside in the States of Florida, New York and Rhode Island (each an “Entrant”). The Promotion is void where prohibited by law. Employees of City Barbeque, LLC (the “Sponsor”) and their respective subsidiaries, parent, divisions, franchisees, promotional partners, agencies, affiliates, advertising and promotion agencies (collectively, the “Released Promotion Parties”) as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, are not eligible to participate in the Promotion or win prizes. The benefits and terms for participation in the City Rewards program are viewable at City Rewards Site (“City Rewards Website”) as well as through our mobile application (the “App” and together with the City Rewards Website, collectively referred to as the “Site”).

Official Rules: This Promotion is subject to these Official Rules, the City Rewards Program Terms and Conditions and Privacy Policy posted on the City Rewards Site (“City Rewards Terms”), and all applicable federal, state, local laws and regulations (the “Governing Terms”). Entrant agrees to the Governing Terms by participating in this Promotion.

Promotion Period: The Promotion runs from January 1–February 29, 2024 (the “Promotion Period”).

Prizes:

• Sixty-nine (69) “BBQ for a Year” Prizes — One Awarded Per City BBQ Location

The approximate retail value of each Prize is $720. The Prize will be awarded as City Rewards “Booked Reward” Credits that will be issued over a one (1) year period as follows:

• The Prize will be awarded as 12 monthly credits of $60 each loaded to the winner’s City Rewards account as “Banked Rewards” (each a “Monthly Credit” and collectively, the “Prize”).
• The Prize is redeemable for food and nonalcoholic drink items at any City BBQ restaurant location.
• The Prize is not valid on catering orders or orders placed on any third-party delivery apps.
• The Prize may not be combined with any other rewards or offers.
• The Prize has no cash value.
• Each Monthly Credit must be redeemed from the winner’s City BBQ App.
• The Monthly Credits will be awarded at the start of each month and will expire thirty (30) days after issuance.
• The Monthly Credit may be redeemed in multiple transactions ranging from $.01 to $60.00.

Prizes are nontransferable, non-negotiable, and non-refundable and must be accepted as awarded. Restrictions, conditions, and limitations may apply. Sponsor will not replace any lost or stolen prize items. Prize award is subject to verification of eligibility and compliance with these Official Rules. Entrant agrees that Sponsor shall not be liable for any damages or losses it may incur using or related to the Prize. Winners are solely responsible for all applicable federal, state, and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified as being provided herein. Failure to comply with the Official Rules will result in forfeiture of the Prize.

How to Enter: During the Promotion Period, an Entrant will receive one (1) entry for each of the following activities (maximum of one entry per day):

• Placing an online order within the City BBQ App or at citybbq.com/order while logged into the Entrant’s City Rewards account;
• Scanning the Entrant’s City BBQ App while placing an order at a City BBQ restaurant; or
• Providing the Entrant’s City Rewards information to a City BBQ team member when placing an order at a Sponsor restaurant (by providing Entrant’s account phone number).

• Free Alternate Means of Entry: An eligible Entrant may also enter up to once per day by sending an email to info@citybbq.com which includes the Entrant’s name, address, phone and email, and preferred City BBQ location.

Selection Of Potential Winner: There will be a separate drawing for each City BBQ restaurant location (each a “Drawing”). The winner of each Drawing will be awarded one BBQ for a Year Prize. Only one Prize, per person, per household will be awarded. All Entries will be given equal weight when selecting a winner. The winners of each Drawing will be selected at random from eligible entries on March 1, 2024. One winner will be selected per Sponsor restaurant location. An Entrant’s location shall be determined from the ‘favorite’ location set by the Entrant in his/her City Rewards account. Odds of winning will vary depending on the number of eligible Entries received. The random drawing will be held by Sponsor or its designated representatives.

All Entries are subject to verification of eligibility by the Sponsor. All decisions regarding Prize awards will be made by Sponsor and are final and binding. In the event of noncompliance with these Official Rules, or if the prize is unclaimed or returned as undeliverable, the Prize will be forfeited and may be awarded to an alternate winner drawn from remaining eligible entries. Sponsor shall not be responsible for lost, late, misdirected, damaged, illegible, incomplete, garbled, or incorrect entries. Entries become the property of Sponsor and will not be returned.Participation constitutes acceptance of these Official Rules in their entirety. Entrant warrants that he/she is eligible to participate in the Sweepstakes and agrees to indemnify and hold harmless Sponsor from any loss, damage, or expense, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of or in connection with participation in this Sweepstakes or the acceptance, use, or misuse of any prize.

Winners’ Obligations (Delivery & Documentation): Before being declared a “winner,” the randomly selected Entrant(s) will be contacted by email and notified that he/she is eligible to win. The selected Entrants must reply within two (2) business days of notification to accept the prize in writing (email sufficient) and provide the Sponsor with his or her identification to verify that the winner is 18 years of age or older, a contact telephone number, email address, and shipping address, if necessary. The potential prize winners may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively the “Prize Claim Documents"). By accepting the prize, the winners represent that they have complied with these Official Rules. Despite the foregoing, entry and acceptance of the prize offered constitutes the Entrant’s permission for Sponsor to use the winner’s name, city, state of residence, likeness, and/or photograph and statements for advertising/trade and all other purposes, in any and all media, and all media now or hereafter known worldwide in perpetuity, including the Internet and social networking sites, without further compensation, notification, or permission, unless prohibited by law. By participating in this Sweepstakes, each Entrant agrees to be bound by these Official Rules and the decisions of the Sponsor.

If a prize is valued at $600 or more the potential winner must sign and return an IRS W-9 form within 14 days of notification in order to claim the prize.

If the selected Entrant: (i) cannot be contacted by email within two (2) business days of selection or there is a return of any prior notification as undeliverable; or (ii) fails to confirm their eligibility, including presenting the required age identification, and acceptance of the prize within the specified time, then he/she will be disqualified and will forfeit the prize, and the Sponsor reserves the right to select an alternate Entrant from among the remaining valid entries.

An Entrant may decline to be a winner by notifying Sponsor within one (1) business day following notification, in which case the declining Entrant forgoes any prize or other features associated with winning the Sweepstakes. Sponsor reserves the right to disqualify an Entrant if Sponsor deems disqualification appropriate.

A list of Sweepstakes Winners will be available upon request to Sponsor at: info@citybbq.com. By accepting a Prize, the Entrant agrees to have his/her name publicized as a Sweepstakes Winner.

Receiving Prizes; Tax Obligations: After verification of eligibility and execution of any Prize Claim Documents, each winner will receive the Prize via the App, mail, email or other means, as appropriate. Allow 30 days from final confirmation for prize delivery. Any winners that receive prizes valued over $600 will receive IRS 1099 form in the amount of their prize at the appropriate time. Prize winners are responsible for any taxes, fees, or other liability resulting from their receipt of a Prize regardless of the value of the Prize.  Sponsor shall withhold from the prize any mandatory federal tax withholdings, plus any applicable state taxes based on where the Winner is located.

Reservation Of Rights: Sponsor reserves the right to modify the dates and deadlines, and the right to modify, add, or remove additional Sweepstakes deadlines for any reason. Sponsor may cancel the Sweepstakes entirely, not award the prize, or select an alternate prize if awarding the Sweepstakes prize as originally described or on the original time frame becomes commercially unreasonable arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, pandemics, government orders related to a pandemic, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, and interruptions, loss, or malfunctions of utilities, communications, or computer (software and hardware) services. Any changes will be communicated via posting of updated terms on the Site.

Privacy Policy: Information collected by Sponsor in connection with this Promotion may be used by Sponsor and shared with third parties involved in administration of the Promotion in accordance with the Sponsor’s online Privacy Policy posted at Privacy Policy | City Barbeque and Catering (citybbq.com). The Entrant agrees to the collection, processing and storage of his/her personal data by Sponsor for the purposes of the Promotion.

Disputes: Entrant agrees that: (a) he/she releases and will defend, indemnify and hold harmless the Released Promotion Parties from and all any and all claims; (b) claims arising out of or connected with this Promotion, or any prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in Columbus, Ohio; (c) Entrant submits to sole and exclusive personal jurisdiction to said courts in the State of Ohio for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (d) any and all claims, judgments, and awards shall be limited to actual damages of no more than $100, including costs associated with entering this Promotion, but in no event attorneys' fees; and (e) under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants or the Released Promotion Parties in connection with this Promotion shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Ohio, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio.

Severability: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision was not contained herein.
